These terms govern your use of ffatatx.com. Please read them before using the site.
1. Who we are
This website is operated by Storeyline Productions LLC, a Texas limited liability company doing business as First Friday Art Trail ATX ("FFAT," "we," "us," or "our"). You can reach us at howdy@ffatatx.com.
2. What these terms cover
These terms apply to ffatatx.com and nothing else. Our online store at shop.ffatatx.com is a separate service with its own terms of service, and any purchase, vendor registration, food truck registration, or sponsorship transaction you complete there is governed by those terms rather than these.
By using this site, you agree to these terms. If you do not agree, please do not use the site.
3. Using the site
You may use this site for personal, non-commercial purposes: reading about the event, signing up for updates, and getting in touch with us. You agree not to interfere with the site's operation, attempt to gain unauthorized access to it, scrape or harvest data from it through automated means, or use it in violation of any applicable law.
4. Our content
The text, photographs, graphics, layout, and the First Friday Art Trail ATX name and logo on this site are owned by Storeyline Productions LLC or used with permission, and are protected by copyright and trademark law. Artwork shown on this site remains the property of the artists who made it.
You may share links to the site and quote briefly from it with attribution. You may not reproduce substantial portions of the site, use our name or logo to suggest affiliation or endorsement, or use our content commercially without written permission.
5. What you send us
When you use our contact form, join our newsletter, or send us an inquiry, you are responsible for the accuracy of what you provide, and you confirm you have the right to share it.
If you send us photographs, artwork samples, music, press materials, or similar submissions in connection with vending, performing, or exhibiting, you grant us a non-exclusive, royalty-free license to use those materials to promote the event and your participation in it, across our website, email, and social channels. You keep ownership of your work. You can ask us to stop using a specific submission by emailing us, and we will honor that request going forward.
Please do not send us confidential information through this site. We cannot treat unsolicited submissions as confidential.
6. Links to other sites
This site links out to services we do not control, including our Shopify store, Instagram, Google Maps, and the HOPE Outdoor Gallery website. We are not responsible for the content, terms, or privacy practices of those services, and a link is not an endorsement.
7. Event information
We work to keep event details on this site accurate, but the event is live and things change. Dates, hours, lineups, vendors, food trucks, and programming are subject to change or cancellation without notice, including for weather, venue conditions, or circumstances outside our control. Admission is free, and we make no guarantee that any particular artist, performer, or vendor will appear on a given night.
Attending the event is separate from using this site, and is subject to any rules posted at the venue.
8. We are an independent event
First Friday Art Trail ATX is an independent event produced by Storeyline Productions LLC. We are not affiliated with, endorsed by, sponsored by, or officially connected to HOPE Outdoor Gallery, or to any other First Friday or art trail event operating under a similar name in Austin or elsewhere.
9. Privacy
Our handling of personal information on this site is described in our Privacy Policy. Our online store has a separate privacy policy covering purchases and registrations.
10. No warranties
This site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of harmful components, or that information on it is complete or current.
11. Limitation of liability
To the fullest extent permitted by Texas law, Storeyline Productions LLC and its members, officers, employees, contractors, and volunteers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of your use of this site, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to this site or these terms will not exceed one hundred United States dollars ($100).
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Storeyline Productions LLC and the people listed above from any claims, damages, losses, and reasonable attorneys' fees arising out of your misuse of this site, your violation of these terms, or your violation of the rights of any third party.
13. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. Any dispute arising out of these terms or your use of this site will be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the jurisdiction of those courts.
14. Changes
We may update these terms from time to time. When we do, we will revise the effective date at the top of this page. Material changes will be noted on this page. Continuing to use the site after we post changes means you accept the revised terms.
15. Severability
If any part of these terms is found unenforceable, the rest stays in effect, and the unenforceable part will be applied to the greatest extent permitted by law.
